This is a piece of information you MUST have when you go to vote in the next election for the 65th Judicial District Court. The judge of that court is Yahara Lisa Gutierrez. This information will not appear in the El Paso Times which has an agenda of supporting all Eliot Shapleigh, Jose Rodriguez, and Ray Caballero candidates. Yahara Lisa Gutierrez is one of five candidates since 2008 to run while continuing to draw a paycheck and benefits from the County Attorney's office.
Gutierrez lied to the voters when she ran for office. She said that the family law docket of the 65th had been neglected by her opponent, Judge Alfredo Chavez, and that she would fix that problem, that she would tend to that docket. She went around town to forums whining how litigants weren't getting temporary child support, how custody matters were languishing on the docket, how families were being hurt by Judge Chavez, yarah, yarah, yarah.
Gutierrez took office on January 2, 2009. She signed an order affective January 2, 2009, her very first day in office, ORDERING the District Clerk to transfer all of her family law cases except those with protective orders to the 171st. She abandoned all those families she used in her campaign and dumped them on a busy court. She dramatically lightened her load while drawing the same paycheck from the voters and providing them with fewer services. In a word, she tricked the voters to get elected. Her courtroom is empty most of the time. I urge you to go by and look.

Thank God for the judge of the 171st, Judge Bonnie Rangel, who is now working overtime for us with three full dockets, criminal, family and civil. Rangel is a Stanford graduate. She speaks and writes beautiful English and Spanish. Both the Prosecution and the Defense love her. Why? Because she will give you a fair trial. Judge Gutierrez' English leaves much to be desired. I will be posting something she wrote in a future blog and you will be amazed as you see for yourself what we are electing to the bench. If Gutierrez is going to play judge and write for public consumption, then she should really look into an English language class. They offer many of them in the ESL department at El Paso Community College. Worse yet, bad English or not, Gutierrez poses illogical legal analyses and, as I have shown, she has issues with telling the truth. Nothing like having a judge who has bad English, bad ethics and a bad legal "mind." What more could we ask for? Mr. John D. Davis of East El Paso wrote a letter to the editor (4-6-2010) condemning Dr. Paul Shrode, the county's chief medical examiner, for not having the honor to resign. It is now statewide knowledge that Dr. Shrode fabricated credentials to include claiming a law degree he doesn't have and having passed boards he, in fact, failed. Some citizens are asking, how is it that Dr. Shrode continues on as the highest-paid county employee ($254,000/year) testifying on life-and-death matters and issuing rulings on causes of death that affect life insurance distributions?
First, Dr. Shrode's employer, El Paso County Commissioners Court, has voted to keep him on. Leading the charge that day was Commissioner Veronica Escobar. In recent hearings, Commissioners Escobar, Anna Perez, Willie Gandara and Dan Haggerty decided to do nothing about Dr. Shrode's lies. Judge Anthony Cobos was the only dissenting voice.
Haggerty actually apologized to Dr. Shrode for his trouble. Escobar and Haggerty were running for election. The voters chose to return them to office.
Second, District Attorney Jaime Esparza has personally gone to Commissioners Court to go to bat for Dr. Shrode. Esparza says that Shrode's lies do not amount to perjury. He says it's no big deal. The voters chose to return him to office.
Third, the county attorney by appointment, Jo Anne Bernal, says, "I wish Dr. Shrode hadn't lied but there is not much I can do about it." Bernal says that she will not use her power to advise her client, Commissioners Court, to fire Shrode. Furthermore, she says Esparza has cleared Shrode, so he is as good as gold. The voters chose to return her to office.
Fourth, it is the duty of prosecutors to not put lying witnesses on the stand. However, prosecutors continue to call Dr. Shrode to testify and even argue to the courts that Stuart Leeds and I should not be able to question Shrode in front of the jury on his lies. Voters continue to elect their bosses, Jaime Esparza and Jo Anne Bernal.
Fifth, judges can disqualify a witness from testifying. Why? Because he is a liar.
Not one judge in 2åyears has disqualified Dr. Shrode from testifying as the medical examiner. Most recently, 8th Court of Appeals Justice Ann McClure had to issue a corrected opinion because she had written a previous, erroneous opinion stating that Shrode was board-certified. Where did McClure get that belief?
Bernal's employee, Bruce Yetter, had called Shrode to testify and he testified he had passed his boards when he hadn't. Despite this embarrassment, McClure also says Shrode is good to go.
Sixth, it is the job of defense attorneys to attack individuals who bear false witness against their clients. To date, outside of Stuart Leeds (chairman of the new Ethics Commission) and myself, not one defense attorney -- to include but not limited to Clara Hernandez, the appointed county public defender -- has used Dr. Shrode's now numerous and different and false résumés and prior false testimony against him in court. Hernandez continues to be appointed to her job by County Commissioners Court. The voters continue to elect them to office.
And here, good citizens, is the answer, and around and around we go.

El Paso Police Jorge Gonzalez shoots Andres Cortez, Press does not ask ????

The El Paso press, including Chris Lopez, editor in charge of the news section of the El Paso Times, and members of the so called TV Media let yet another shooting by an El Paso Police Officer of a citizen go by without asking the obvious questions. It was reported in the El Paso Times and tv media that off duty El Paso Police Officer Jorge Gonzalez shot 20 year old Andres Elias Cortez in the neck on Thursday, April 1, 2010. They tell us that El Paso Police spokesman Mike Baranyay says that Andres Cortez hit a car with two off duty police officers, Jorge Gonzalez and Machelle Gonzalez, in it. Baranyay says that Cortez tried to get away and in doing so he hit Machelle Gonzalez and then was going to try and run over her again at which point Jorge Gonzalez shot Cortez in the neck. (She has non-life threatening injuries. Did he really hit her?) They say that Cortez is in the hospital and will most likely be a quadraeplegic. Cortez may also face charges of aggravated assault on top of it all. Furthermore, Baranyay, after giving the above rendition of events, says that the case will be investigated by the police (who is he if not the police?) and by the District Attorney's office (which will no doubt, based on the past, be a whitewash). The question is, police spokesman officer Baranyay has already told us what happened so what are the investigations for if he has already figured it all out? And how did Baranyay figure it all out, if it hasn't been investigated yet? This is an obvious question that has not been answered or probably even asked or thought of by Chris Lopez and other media outlets, who have a duty to ask. Why have they not asked this question as well as others? This is the second cop shooting of a motorist in less than one year. Sgt. Lewis Johnson shot and killed a motorist last year.
The press tells us that the officers identified themselves to Cortez as police officers. Why were they identifying themselves as police officers if they were off duty? At what point did they do this? Which of the cops got out the car and when? Did they both get out? If they both got out of the car, why did they both get out of the car? Who was driving? Whose car was it?
What time did the accident occur? How bad was the accident? What do the cars look like? Who in fact hit whom? Why have we not seen pictures of the cars? Why were the officers together? Are they friends? Married to each other? Married to other people? Relatives? Where were they going? Where were they coming from? Had they been drinking? Was the gun a service revolver or Gonzalez' personal gun? If so, does he have a permit?
Did both cops pull their guns? At what point was the gun pulled, or guns pulled? When they were approaching Cortez? Were both cops armed? Was Cortez fleeing people in plain clothes who had guns pulled? If so, should that have bought him a bullet in the neck and a lifetime condemned to a bed?
What is Cortez' criminal history if any? The police always IMMEDIATELY pull out criminal histories of people they shoot to show how dangerous they are. Since we have not heard of any history can we assume that there is none? Is Cortez just a regular old 20 year old who had the bad luck of coming across the path of two El Paso Police Officers who come from a department that is notorious for its poor training?
What are the records of the cops in question? Have they been disciplined in the past?
Why are the police shooting at motorists instead of at the tires of the vehicle?
Is this another example of poor training of our police?
Why does the press allow the police spokesman to get away with declaring what has happened and then in the next breath let him claim it is under investigation?
Why does the press not ask questions of Mayor Cook and city councilmen who are accountable to the voters for the actions of the police? Why does the press not ask questions of our worthless city manager Joyce Wilson who has positioned herself to be in charge of our police department, a woman who is from out of town (We can't find anyone locally who can mismanage our money as gloriously as she can. We are 18 million in the hole and counting) and who draws a fat cat salary of $250,000/year? At the very least we should be able to expect some answers from the overpaid Ms. Wilson regarding this great tragedy. But then that would require an intelligent press that understands its role.

Yahara Lisa Gutierrez, Some Unpleasant Facts

One serious problem in the El Paso Judicial System is Judge Yahara Lisa Gutierrez of the 65th Judicial District Court. The 65th is the largest court at the court house, supervising three and half court masters (judges), having jurisdiction over the entire juvenile case load and the entire CPS case load, and until recently 1/3 of the family law case load. The 65th possesses control over 4 and a half court rooms, four and half bailiff’s, four and half court coordinators and four and half court reporters. This is a huge staff. Many hundreds of thousands of tax dollars are spent on the upkeep of these courts. Would you be interested in seeing a few facts about Yahara Lisa Gutierrez, the judge in control of this whole operation whom El Pasoans elected and who took the bench in January 2008? You will not read this in the El Paso Times.
-Yahara Gutierrez ran on the platform that her opponent, the incumbent, had neglected his family law docket and that she would right this wrong and “Put El Paso Families First.”
-One of the first things Gutierrez did when she took office was to abandon her family law docket and shunt it over to the 171st Judicial District Court. So much for caring for El Paso families. So much for telling the electorate the truth when she was running for office that her idea of taking care of El Paso families was to kick their cases to another, very busy judge.
The question now is, what does Gutierrez do all day in that big empty court room we pay for? All the CPS cases are heard by a court master. All of the juvenile cases are heard by two court masters at the juvenile hall building on Delta Street. The protective orders are heard by a court master. Gutierrez has relegated herself to be the supervisor of court masters. The 65th used to be such a busy court with juries coming and going. Now, with Gutierrez on the bench, it is as quiet as a library up there.
However, in Gutierrez' defense, it could be that she got rid of her complex family law cases because she knew they were out of her league. I personally thank God she removed herself from these cases and gave them to a competent judge, the Judge of the 171st.
If you were about to be divorced with your children’s custody on the line and property division at stake, would you not want a respectable, truth-telling, sober, intelligent judge making decisions on your case and determining your family's fate? Or would you want the following? Someone who the police said they arrested for driving drunk, traveling 90 miles per hour? Someone the police said swerved across two white lines, twice? Someone the police said popped a mint into her mouth during a DWI investigation? Someone who the police said had glassy, bloodshot eyes, an odor of alcohol about her breath and person? Someone who the police said had slurred speech? Someone who was not able to produce a driver’s license? Someone who the police said could not maintain her balance when exiting her vehicle? Someone who the police said placed her hand on her car to prevent herself from staggering? Someone who the police said informed them that she was unemployed when in fact she was working as a prosecutor, an assistant county attorney (for Jose Rodriguez and her pal Jo Anne Bernal) prosecuting juveniles for DWI? Someone who the police said told them she used to work for the County Attorney as a clerk, when in fact she had business cards in her purse that said she was an assistant county attorney? Someone who refused to take the field sobriety tests or the breath tests?
Someone who ran on the campaign platform with the above on her record, while criticizing her opponent for keeping a decanter of alcohol in his chambers (not illegal by the way)? That someone would be Yahara Lisa Gutierrez.
Keep in mind the El Paso Times knew and knows all about the above and refuses to properly inform you. Even while it publishes articles about the budget deficit, it remains silent on Gutierrez' fallow court, how she abandoned her family law docket and how she still receives her full salary. Gutierrez is also not on the list of elected officials volunteering to take furlough days. Gutierrez draws the same pay as her predecessor and provides fewer services. Because after all, who will ever find out? The El Paso Times is too stupid to do a story or too dishonest. They have bigger fish to fry with all this controversy about idiot city reps arguing to legalize marihuana.

I showed my brother her booking photo, which was published by El Diario, and asked him to not read the article but at first glance, what did he think this woman had been arrested for? He answered promptly: "prostitution."

Through answers elicited by my cross-examination, your witness, Dr. Shrode, admitted that he did not possess a law degree as he had listed on his resume, and as he had testified to under oath, in open court, on the record. Mr. Yetter personally handed Dr. Shrode’s false resume to the Court and had it admitted into evidence to be given to the jury.
As the County Attorney by appointment only (by a three to two vote, no election), as head of the office that put Dr. Shrode on the stand as a witness when he admitted to having put false information on his resume, as advisor to Dr. Shrode’s employer, El Paso County Commissioner’s Court, as legal counsel to Human Resources that should have but did not check Dr. Shrode’s credentials, as employer to assistant county attorney Holly Lytle who had a part in the selection of Dr. Shrode, as a person subject to the El Paso Ethics Commission, as a person seeking to advise such Commission and as a public official who has taken the public position that Dr. Shrode claiming to have credentials that he does not have is nothing but “puffery,” I invite you to a debate on the issue of El Paso Medical Examiner Dr. Paul Shrode. As we are the two main protagonists in this matter with diametrically opposing opinions on the applicable law, on the ethics and on what is in the best interests of this community regarding Dr. Paul Shrode as Medical Examiner, I challenge you to join me in writing competing op-ed pieces on the issue. Should you accept the challenge, I would ask that you join me in requesting of Mr. Edgren of the El Paso Times that he publish the pieces so that the community gets the benefit of both of our views on this most important of matters.

As we are the two main protagonists in this matter with diametrically opposing opinions on the applicable law, on the ethics and on what is in the best interests of this community regarding Dr. Paul Shrode as Medical Examiner, I challenge you to join me in writing competing op-ed pieces on the issue. Should you accept the challenge, I would ask that you join me in requesting of Mr. Edgren of the El Paso Times that he publish the pieces so that the community gets the benefit of both of our views on this most important of matters.
